NOTICE OF INTENTION TO ADOPT SEWER CODE ORDINANCE CHANGES
NOTICE IS HEREBY GIVEN that on Tuesday, January 10, 2017, City Council will consider adopting sewer code ordinance changes at the regular City Council meeting at 7:00 pm or shortly thereafter, at Cotati City Hall, 201 West Sierra Avenue. The full text of the proposed ordinance changes is available at the Deputy City Clerk’s office at the Cotati City Hall. A summary of the sewer code changes is as follows:
As a member of the Santa Rosa Subregional Sewerage System, the City is responsible for meeting State and Federal regulatory requirements and needs to revise its sewer code periodically to reflect changes in those regulations. The City of Santa Rosa, which owns and manages the Subregional System, recently amended its Sewer Code to incorporate changes in the Environmental Protection Agency’s (EPA) Pre-treatment Program requirements and the City needs to do the same to be consistent with the EPA Pre-treatment program requirements.
In the process of incorporating these changes into the City’s sewer code, there were a number of other revisions to cleanup and clarify the code.; As a result, Chapters 13.34 through 13.38 of Title 13 (Water, Sewer, and Electrical) are proposed to be amended and restated in their entirety.
The following changes are needed to comply with the Pre-treatment Program: (1) adding a definition for “Non-Significant Categorical Industrial User,” (2) revising the definition for “Authorized Representative,” (3) revising the criteria for Significant Non-Compliance, and (4) revising the local limits provision to add a reference to the Federal Register for a list of “Total Toxic Organics” chemicals.
In addition to these changes, revisions were made to a) provide general authority to the director of utilities for the City of Santa Rosa to administer and enforce the City of Santa Rosa’s pretreatment program, (b) replace the “director of public works” with the director of utilities” where necessary, or add the director of utilities in cases where both the director of public works and the director of utilities in cases where both the director of public works and the director of utilities have authority, and c) delete definitions that are not being used in the ordinance.
